4 Year Old Killed during DUI Accident

On Sunday, a 4 year old boy was killed after a man driving under the influence (DUI) crashed into the back of a truck that had stopped on the side of U.S. 101.
Immediately following the accident, 44 year old James Francis Lee was arrested and the boy that was killed was identified as Jose Cortez-Diaz.
The collision occurred at approximately 5:53 PM. At the time of the accident, the boy was with his family in a 2001 Chevrolet S-10 pickup truck that was being driven by his father. The father had to pull over onto the right shoulder when the vehicle suddenly became disabled. He got out of the truck and walked over to the passenger side to grab his son when a 1989 Ford F-250 served and entered the shoulder, striking the parked vehicle from behind.
The boy suffered serious head injuries and had to be rushed to Santa Clara Valley Medical Center. He was pronounced dead at 7:20 PM and his father suffered a broken jaw and broken rib.
Police booked Lee into the county jail on charges of suspicion of felony DUI and vehicular manslaughter.
