Sex Crime Appeal is Unsuccessful
John Jacques, 60, has tried to appeal his charges of facilitating sex with a child to no avail, and the public couldn't be happier.
The La Crosse man was convicted back in 2008 when he tried to engage what he thought was a 13-year-old girl into having graphic conversations with him online. He quickly learned that it was actually a Holmen police officer working to trap perverts just like him.
Not only did the judge see conversations that Jacques had attempted to start with a young girl but naked pictures of himself as well. Although he attempted to argue that the prosecutors showed the jury only static images of emoticons that he claimed were "clear evidence of enticement." The appeals court was not impressed with his argument, however, stating that he he had no legal basis for his appeal.
Jacques also blames his prior attorney for not questioning the officer about the emoticons during the trial process.
